LEGAL NOTICE
NOTICE IS HEREBY GIVEN that the Lower Southampton Township Zoning Hearing Board will hold a public hearing on February 8, 2022 beginning at 7:00 P.M. at the Sarah Mitchell Community Center, 1500 Desire Avenue, Feasterville, PA 19053 for the purpose of reorganizing the Board in accordance with applicable law and considering the following applications:
Application Z22-01. Application of 604 E. Bristol LLC c/o Insite Property Group, equitable owner of the property at 604 E. Bristol Road, identified as Bucks County Tax Map Parcel 21-023-158-002. The Applicant seeks the following in connection with a proposal to eliminate the existing non-conforming structures on the property to construct a self-storage facility: 1) a variance from Section 27-801.1 of the Zoning Ordinance to permit a Use 65 – standard self-storage facility, whereas such a use is otherwise not permitted within the C-1 Light Industrial Zoning District; 2) a variance from Section 27-802.B of the Zoning Ordinance to permit building coverage of 38. 9%, whereas building coverage exceeding 35% is otherwise not permitted; 3) a variance from Section 27-802.H of the Zoning Ordinance to permit an impervious surface coverage ratio of 71.2%, whereas only 60% impervious coverage is otherwise permitted; 4) a variance from Section 27- 1403.G(11)(a)(1) to permit a standard self-storage facility on a lot maintaining 4.42 acres, whereas a minimum lot area of 10 acres is otherwise required; 5) a variance from Section 27-1403.G(11)(a)(4) of the Zoning Ordinance to permit a 36.9′ setback from the ultimate right-of-way of Brownsville Road, whereas a 75′ setback from street lines is otherwise required; 6) variances from the provisions of Section 27- 1403.G(l l)(a)(5) to permit 11.2′, 35′, and 36.2′ side yard setbacks, whereas 100′ setbacks from “other lot lines” are otherwise required; 7) a variance from Section 27- 1403.G(11)(a)(7) of the Zoning Ordinance to permit the storage units to have a maximum height of 28′; whereas storage units exceeding 12′ in height are otherwise not permitted; 8) a variance from Section 27-1715.1 of the Zoning Ordinance to permit a retaining wall structure within a required front yard, whereas no structures “within the minimum depth from the front of the lot line” are otherwise permitted; 9) a variance from Section 27-1716.1 of the Zoning Ordinance to permit a retaining wall structure within a required side yard, whereas structures are not otherwise be permitted therein; 10) a variance from the provisions of Section 27-1720.A to permit natural resources setbacks to be measured from the edge of lot lines whereas the setbacks would otherwise be measured from the edge of natural resources; 11) a variance from the provisions of Section 27-190 l .JJ of the Zoning Ordinance to permit the facility to maintain 17 parking spaces, whereas an office use with 1,000 square feet of gross floor area and an industrial use with 126,000 square feet gross floor area are otherwise required to maintain 47 parking spaces; and 12) a variance from Section 27-2307.1 of the Zoning Ordinance to permit additional time to obtain a zoning permit following the grant of a variance, whereas six (6) months would otherwise be allotted to obtain a zoning permit.
Application Z22-01. Application of 055 (Zero) Prop., L.P., owner of the property identified as Bucks County Tax Map Parcel 21-008-005, and Gerard and Ann Clabbers, owners of the property identified as Bucks County Tax Map Parcel 21-008-006.1. The Applicants seek the following in connection with a proposal to develop the properties into eight (8) apartment buildings for use as 56 over 55 dwelling units: 1) a variance from Section 402(1) of the Zoning Ordinance to permit a Use 6 – multifamily dwelling, whereas such a use is otherwise not permitted within the R-1 Residential Zoning District; 2) a variance from Section 27-1901.C of the Zoning Ordinance to permit 128 parking spaces for 57 units (2.25 parking spaces per unit) whereas 3 spaces per unit is required; 3) a variance from Section 27-403.E to permit 33.6% impervious coverage, whereas 30% is permitted; and 4) a variance from Section 27-1403(10)(d) to allow a side yard of 13.4 feet between Units 5 and 6, whereas 50 feet is required.
All interested persons are invited to attend and participate in accordance with the rules and procedures prescribed by Lower Southampton Township Zoning Hearing Board.
