NOTICE IS HEREBY GIVEN that the Lower Southampton Township Zoning Hearing Board will hold a public hearing on March 28, 2023 beginning at 7:00 P.M. at the Lower Southampton Township Administration Building, 1500 Desire Avenue, Feasterville, PA 19053 for the purpose of considering the following applications:
Application Z23-02. Application of Carmen Petrella owner of the property at 530 Clearview Avenue, identified as Bucks County Tax Map Parcel 21-016-458 (the “Property”), located in the I, Industrial Zoning District of Lower Southampton Township. The Applicant intends to demolish the existing improvements on the property, including the fire-damaged single-family residence and the existing motor vehicle repair shop and, in their place, construct a 5,535/sq. ft. building for contractor offices and shops and a 3,905 sq. ft. stone parking area. The Applicant seeks an interpretation that the Plans are permitted as an alteration, reconstruction, or enlargement of existing structures that do not increase the extent of the existing nonconformities pursuant to §2102.1. Alternatively, the Applicant requests the following four (4) variances from the Lower Southampton Township Zoning Ordinance: (1) from §1002.E, to permit a right side yard setback, reducing the nonconformity, from 9.14 feet to 18.50 feet, where 25 feet is required; (2) from §1002.E, to permit a left side yard setback of 18.50 feet, where 25 feet is required; (3) from §1002.F, to permit a rear yard setback, reducing the nonconformity, from 0 feet to 5 feet, where 35 feet is required; and (4) from §1002.G, to permit a buffer yard, reducing the nonconformity, from 0 feet to 12.5 feet, where 25 feet is required.
Application Z23-03. Application of Muhammad Mian owner of the property at 650 W. Street Road, identified as Bucks County Tax Map Parcel 21-003-159 (the “Property”), located in the C-2 Heavy Commercial Zoning District of Lower Southampton Township. Applicant seeks to open a retail Vape Shop within a 1,600 square foot unit in a shopping center. Use 46 Smoke Shop is permitted within the C-2 Heavy Commercial Zoning District of Lower Southampton by Special Exception, under §27-901.2 of the Lower Southampton Township Zoning Ordinance (“Ordinance”), subject to the specific criteria found at §27-1403.E(24) of the Ordinance, and the general criteria found at §27-2306 of the Ordinance.
Application Z23-04. Application of Justin Napierkowski owner of the property at 58 Dolton Road, identified as Bucks County Tax Map Parcel 21-010-144 (the “Property”), located in the R-1, Residential Zoning District of Lower Southampton Township. Applicant seeks to construct a sport court in the side and rear yards of the subject property. The sport court is considered an accessory structure pursuant to §27-202 of the Lower Southampton Township Zoning Ordinance (“Ordinance”). An accessory structure is a permitted use within the R-1 zoning district in which the property is located, pursuant to §27-402 of the Ordinance. Applicant seeks variances to locate the structure less than five (5) feet from the rear and side lot lines, respectively, and to exceed a 500 square foot area. See §27-1403, Use 70.
