NOTICE IS HEREBY GIVEN that the Lower Southampton Township Zoning Hearing Board will hold a public hearing on Tuesday, April 22, 2025, beginning at 7:00 P.M. at the Lower Southampton Township Administration Building, 1500 Desire Avenue, Feasterville, PA 19053 for the purpose of considering the following application:

Application Z24-05. Application of Trinetra Realty Holdings PA LP, owner of the property, located at 1150 Bustleton Pike, identified as Bucks County Tax Map Parcel No. 21-007-157 (the “Property”), located in the C-2 Heavy Commercial Zoning District of Lower Southampton Township. Applicant seeks to reestablish a Use 35 Motor Vehicle Fueling Station, now with a combination gas station/ convenience store use on the subject property. Applicant originally sought the following variances in order to reestablish the use: (1) §27- 902.B, to allow a building area of 29.2%, where no more than 25% of the area of each lot shall be occupied by buildings; (2) from §27-902.D, to permit a side yard setback distance of 5.7 feet, where a minimum of 20 feet is required; (3) from §27-902.E, to permit impervious surface coverage of 98%, where a maximum of 60% is permitted; and, (4) from §27-1901, to permit 16 parking spaces, where 40 are required. Applicant has amended the application to include the following additional relief: a variance from §27-902.D and §27-1716.1 to allow a minimum side yard of 5.7 feet, where 20 feet is required; and, acknowledgement of the following nonconformities or revision thereto, or variance therefrom; (1) §27-901.2, to permit a motor vehicle fueling station by special exception (asserting the site was previously a gas station);

(2) §27-902.A to permit a lot area of less than one acre (asserting that the existing lot for the prior use is .584 acres); (3) §27-902.C and §27-1715.1, to permit a front yard of 12.59 feet, where 35 feet is permitted (asserting that the existing front yard is 0 feet); (4) §27-902.E, to permit an impervious surface area of 90%, where 60% is permitted (asserting that the site is currently 90% impervious cover); (5) §27-902.F and §27-1717, to permit a rear yard of 4.53 feet, where 35 feet is required (asserting that the existing structure is two feet from the rear property line);

(6) §27-1403.E(13)(a)(3), which requires a minimum lot area in the C-2 District of two acres (.584 acres exists); (7) §27-1403.E(13)(a)(4) and §27-1711, to permit a lot width of 190 feet, where 250 feet is required (asserting an existing condition); (8) §27-1403.E(13)(d), to permit the proposed fuel pumps and canopies to be 12.59 feet from the ultimate right of way, where 25 feet is required (asserting 0 feet from ultimate right of way as an existing condition); and,

(9) §27-1710, to permit the use of the lot smaller than what is permitted in the zoning district.
