LEGAL NOTICE
NOTICE IS HEREBY GIVEN that the Lower Southampton Township Zoning Hearing Board will hold a public hearing on Tuesday, July 8, 2025, beginning at 7:00 P.M. at the Lower Southampton Township Administration Building, 1500 Desire Avenue, Feasterville, PA 19053 for the purpose of considering the following application:
Application Z25-06. Application of Vardgas Oganisean/V&V Holdings, LLC, owner of the property, located at 116 Second Street, identified as Bucks County Tax Map Parcel No. 21-010-118 (the “Property”), located in the R-3, Residential Zoning District of Lower Southampton Township. Applicant has filed an amended application seeking an interpretation from the Zoning Hearing Board that the Subject Property at issue represents two (2) lawfully non-conforming lots which never merged. Applicant further seeks, based upon the Board’s interpretation, a special exception pursuant to Chapter 27, Part 17, §27-1712 (Exceptions to minimum lot areas and lot widths) and Chapter 27, Part 2, §27-2306; and a variance from the 7,000 square foot minimum lot requirements in §27-1712(1) to allow construction of a single family dwelling (Use 3) upon a 5,310 square foot property.
In the alternative, Applicant seeks variances from Chapter 27, Part 6, §27-603(A) to permit construction of a by-right single family dwelling (Use 3) on a lot that is less than the required 9,000 square feet minimum lot area; and a dimensional variance from Chapter 27, Part 6, §27-603(C) to recognize the existing 3.8 feet side yard referable to the dwelling located on Parcel B is legally nonconforming.
Before amending the Application, Applicant initially proposed to subdivide an existing lot into two lots, each to support a single-family dwelling. §27-603A of the Lower Southampton Township Zoning Ordinance (“Ordinance”) requires a 9,000 square foot lot area. §27-603.C of the Ordinance requires a minimum eight (8) foot side yard on each side, with a minimum aggregate of 20 feet. The proposed lots are on the order of 5,300 square feet each. The proposed side yards are less than required by Ordinance. Applicant seeks variances to support the proposed subdivision and development.
